Applying to cancel a claim

An enterprise may apply for a cancellation of claims. The rules to have a claim cancelled are strict, and there are many conditions to have an application approved.

Enterprises that are still operational, will normally not have their claims cancelled. 

The rules for having a claim waived are very strict

The main rule is that if you've received a claim from public authorities, you must pay it voluntarily or by enforced collection. Exceptions will usually only apply if your personal circumstances are very bad and you are permanently unable to pay. 

To reduce the claim, you must send us a proposed payment plan. The proposed payment plan must represent your best possible offer. 

If your claim is older than ten years, you can apply for cancellation without having to propose a payment plan. 

We'll be able to waive your full claim if ordinary collection is not profitable for us, and if waiving the claim does not appear offensive to others or the public in general. By offensive in this context, we mean that other people may have a negative reaction to a reduction of your claim. 

The collection continues until the case is settled

Be aware that an application for the cancellation of a claim will usually not stop the collection process. The collection process will not be stopped unless your application is approved. 

How to apply for cancellation of a claim

You must send a written application and include the following: 

  • the company's name and organisation number 
  • a power of attorney stating that you may represent the enterprise 
  • a proposal for payment if you're applying for a cancellation of parts of the claim 
  • approved accounts and income statement/tax information for the last three years 
  • information about any other debt, if relevant with an overview of the priorities of the claims and whether they have been secured by attachments or similar

If you are responsible for the enterprise, you may apply for the waiving of penalties for late filing or an exemption from joint and several liability if the claims are a result of unexpected circumstances that were outside of your control. 

The Brønnøysund Register Centre will process the application. In some cases, they may also waive claims that meet the criteria for special circumstances. The conditions are strict, and it is difficult to have the claims waived.

Send the application to the Brønnøysund Register Centre, or to the Norwegian National Collection Agency (SI) for forwarding.
